The Website includes Artoficial’s ecommerce store at https://artoficial.pro/store/ (the “Store”), this Privacy Policy also applies when you purchase anything from the Store. The controller of your data is Artoficial OÜ, a legal entity established in accordance with Estonian laws (“Artoficial”). 1. What kind of personal data does Artoficial collect?
Artoficial Store is an online environment for selling art. Each artwork featured in the Store (the “Artwork”) is an unique piece of art. There is only one of each Artwork available. However, Artoficial Store is not quite like any other store you have visited before. In addition, it is an art experiment – every Artwork bought via the Store will be registered in the project archive. For the success of the experiment, it is vital to make sure that Artoficial is aware of each owner of each Artwork. We collect the following information during checkout process:
- Identification data: first and last name; company name (if applicable);
- Contact details: postal address; email address; phone number;
- Purchase information: purchase time, name of the Artwork, price of the Artwork at the time of purchase; Credit card or Paypal information (only to the extent necessary to verify payment);
- Customer support content (if applicable).
2. How does Artoficial collect the personal data?
We collect your personal contact information from Artoficial Store through shopping cart checkout page in order to be able to fulfil your purchase and deliver the Artwork to you, on your postal address you have provided us. We may also collect your information when you:
- request information about Artworks;
- provide us information via our Website, by telephone, email or mail;
- subscribe to our mailing lists;
- connect with us through social media services (YouTube, Facebook, Instagram, LinkedIN, Twitter);
- sign up for our social media notifications.
3. What are the purposes of the processing?
Artoficial is first and foremost an ecommerce store. In order to buy Artwork, you have to conclude a contract with Artoficial. Therefore, Artoficial processes your personal data for the performance of the contract and in order to take steps prior to entering into a contract. It is not possible to purchase any Artwork in the Store without providing identification data, contact data and transaction data.
Furthermore, the processing might be necessary for compliance with legal obligations to which Artoficial is subject. For example, Artoficial is required to organise the accounting and financial reporting.
Artoficial will also process your personal data if the processing is necessary for the purposes of the legitimate interests pursued by Artoficial. In every such case Artoficial will consider whether such interests might be overridden by the interests or fundamental rights and freedoms of the data subject. Artoficial is conducting an art experiment. In particular, the retention of some data for a longer period (location of the Artwork, name of the owner), will be necessary to carry out the experiment. Artoficial also has the legitimate interest to process your data to help with fraud identification and prevention.
Artoficial can process your personal data if you have given consent to the processing of your personal data for one or more specific purposes. For example, we will not spam our customers with unnecessary emails about the ongoing experiment and progress, unless our customer requests that type of information from us. You have the right to withdraw your consent at any time. However, we remind you that the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
4. Where we store and process personal data?
We process your personal data in the European Union and European Economic Area. We place great importance on the security of all personally identifiable information associated with our users. We have security measures in place to protect against the loss, misuse and alteration of personal information under our control. If the data is transferred to a third country, we implement appropriate safeguards and means. We will carefully assess all the circumstances and make sure appropriate safeguards are put in place so that your rights are not in any way undermined. We make sure that conditions to enforce your rights and effective legal remedies are available.
5. How long do we retain your personal data?
Artoficial has both the right and the obligation to retain the personal data collected for a period of time. Artoficial does not retain personal information longer than necessary to achieve the purposes of processing and comply with the obligations of Artoficial. We store customer information mainly in regard to the art experiment, so that we would know where each of the Artworks is located in the world.
As a general rule Artoficial will keep your personal information for 3 years since the expiration of any contracts or agreements concluded with you. Please note that together with the sales agreement, you will also enter into a commission agreement with Artoficial. The agreement is concluded for 15 years (for more information, please read the T&C).
The information contained in the accounting records will be retained for seven years in accordance with the applicable law. If Artoficial sends personal information to another controller, the data retention periods will be determined by the recipient of the data.
6. To whom and why we transfer your personal data?
Artoficial discloses personal information only to the extent and in the form necessary for the fulfilment of the purposes listed in the Privacy Policy. As a general rule, we don’t transfer or share the data of our customers to any parties or organizations. Artoficial may share information with companies that provide support services to Artoficial (logistics, e-mail, marketing). These companies may need information about you in order to perform their functions. Data processors are not authorized to use the shared data for any other purpose.
Artoficial is required to transfer personal data if Artoficial is legally bound by such an obligation. For example, Artoficial might be obligated to disclose personal data to public authorities upon their legitimate request.
7. What about your rights?
You have the right to receive information about the personal data processed by Artoficial. Please note that all the data we have, has been collected from you (we do not collect data from third parties) and the processing activities are described in this Privacy Policy. However, if you have any further questions, feel free to contact us.
You also have the right to request the correction or updating of data if it turns out that the personal data being processed is inaccurate. You have the right to obtain restriction of processing or the erasure of your personal data from Artoficial if the preconditions are met. Please note that it is not an absolute right. We can only delete data for which there is no legal basis or need to process it.
Artoficial will fulfil your request within a reasonable time, but no later than one month after receiving the request.
In case of any suspected infringement of your privacy, please contact us. We’ll try to resolve the dispute by negotiation. However, you also have the right to lodge a complaint to the supervisory authority. In Estonia the supervisory authority is Estonian Data Protection Inspectorate (www.aki.ee).
